Dispute over the “Dupla” brand
The acquisition of all the intangible rights of the insolvent Dupla GmbH, such as national and international trademarks and brands, by Dohse Aquaristik KG of Gelsdorf has ensured that the “Dupla” brand will continue to exist, according to a press release issued by Dohse Aquaristik. The former managing director of Dupla GmbH, Jörg Plöger, has been appointed national and international marketing manager at Dohse Aquaristik with responsibility for the overall range. “Dupla” is to be marketed alongside “Hobby” as Dohse’s second in-house brand of aquatics products, with both brands being supplied together by Dohse’s field sales force from January 2004, according to the company.
Red Sea is disputing Dohse Aquaristik’s portrayal of the situation, pointing to an agreement reached with the former Dupla proprietor Jörg Plöger in September 2002.  “As part of this agreement, Red Sea has acquired all of Dupla’s know-how and production equipment including formulas, technical specifications, plastic injection moulds, tools and the machinery necessary to produce the entire Dupla product range. In addition, Red Sea holds the exclusive licence from Kaspar Horst to produce and market the unique ‘DuplaPlant’ and ‘DuplaPlant 24’ range of fertilizers”, the Israeli company announced in a press release.
Dohse Aquaristik is nevertheless sticking to its guns and points out that, when the insolvent Dupla GmbH was put up for sale by the insolvency administrator, Red Sea made an offer that was bettered by Dohse Aquaristik. If Red Sea had already been in possession of the intangible rights of Dupla at that time, according to Dohse Aquaristik, it would not first have had to acquire these from the insolvency administrator.
